Terms of Use
EduCase Terms of Use
1. Introduction and Acceptance
Welcome to EduCase, an online educational platform operated by RadOnc eLearning Center, LLC, a Wyoming limited liability company ("Company," "EduCase," "we," "us," or "our").
These Terms of Use ("Terms") govern access to and use of EduCase websites, educational applications, clinical case training tools, examination services, learning modules, and related services (collectively, the "Services").
By accessing or using the Services, creating an account, or accepting these Terms during registration, you agree to comply with them and with our applicable Privacy Policy.
If you access the Services on behalf of an institution or organization, you represent that you are authorized to do so.
Separate Service Agreements: Certain Services are governed by written agreements between EduCase and institutional clients, including medical societies, universities, hospitals, residency programs, examination boards, and workshop organizers.
Where a signed Service Agreement conflicts with these Terms, the signed Service Agreement shall take precedence for that engagement. These Terms shall otherwise apply to all users.
2. Nature and Purpose of EduCase Services
EduCase provides technology and infrastructure supporting medical education, radiation oncology training, clinical contouring exercises, professional workshops, residency education, competency assessments, examinations, and related educational activities.
Services may include:
- Access to clinical imaging cases and educational datasets.
- Contouring, evaluation, comparison, and assessment tools.
- Educational modules, quizzes, and examinations.
- Assignment management and participant reporting.
- Faculty and administrative interfaces.
- Technical setup, platform support, and workshop assistance.
- Additional educational technologies made available by EduCase.
Unless expressly agreed otherwise, EduCase acts as the educational technology provider rather than the clinical educator, examination authority, course organizer, or certifying body.
Participating institutions, faculty members, and examination authorities remain responsible for educational content, instructional decisions, assessment standards, candidate evaluation, and certification determinations.
3. Educational and Clinical Disclaimer
EduCase is intended for educational, training, research, and assessment purposes as expressly authorized.
Unless a specific product is explicitly designated and authorized for clinical use, EduCase Services are not intended for patient diagnosis, treatment planning, clinical decision-making, or direct patient care.
Educational cases, reference contours, automated measurements, scores, AI-generated outputs, and assessment results may contain errors or limitations and must be evaluated by qualified professionals.
EduCase does not independently certify the clinical accuracy of all faculty-provided materials or guarantee any particular educational or examination outcome.
4. Account Registration and Access
Users may be required to register for an account and receive authorization through an approved educational program, institution, subscription, or other authorized arrangement.
Users agree to:
- Provide accurate registration information.
- Protect their login credentials.
- Use only their individually assigned account.
- Refrain from sharing or transferring account access without authorization.
- Access only the cases, courses, and functions assigned to them.
- Promptly report suspected unauthorized access.
Institutional access is limited to the authorized participants, cases, features, and access periods established in the applicable Service Agreement.
EduCase may suspend or restrict access where reasonably necessary to protect platform security, prevent unauthorized use, satisfy legal obligations, or address material violations of these Terms.
When practicable, EduCase will provide notice and a reasonable opportunity to resolve non-emergency violations before permanent termination.
5. Intellectual Property and Licensing
The EduCase platform, software, interfaces, trademarks, original educational materials, documentation, algorithms, and related proprietary technologies are owned by RadOnc eLearning Center, LLC or its respective licensors.
Users receive a limited, non-exclusive, non-transferable, revocable license to access and use authorized Services during the applicable access period.
This license does not transfer ownership of EduCase technology or intellectual property.
Without express written authorization, users may not:
- Copy, reproduce, redistribute, sublicense, or resell EduCase software or proprietary educational content.
- Reverse engineer or attempt to extract proprietary source code.
- Collect or download case libraries through automated or unauthorized means.
- Circumvent licensing, security, or account access restrictions.
- Use EduCase content, platform outputs, or datasets to train commercial AI systems or develop competing datasets or products.
Institutional clients and content contributors retain ownership of their original materials unless otherwise provided in a separate written agreement.
By submitting authorized content, the submitting party grants EduCase the limited rights necessary to host, process, display, evaluate, and otherwise use that content to provide the contracted Services.
EduCase does not acquire ownership of client-submitted clinical cases merely by hosting them.
Any secondary use, redistribution, commercial licensing, or external AI model training involving client-submitted clinical datasets requires a separate legal basis or appropriate written authorization.
6. Clinical Data and Content Responsibilities
Institutions, case contributors, and organizers are responsible for ensuring they have the legal authority and necessary permissions to submit, upload, or distribute educational cases, imaging datasets, and related materials.
Clinical datasets submitted for educational use must be appropriately de-identified in accordance with applicable requirements and contractual obligations.
Users must not knowingly upload identifiable patient information without an appropriate written agreement and required privacy and security arrangements.
EduCase may reject, restrict, quarantine, or remove content that reasonably appears to violate legal, security, privacy, or intellectual property requirements.
Case contributors are responsible for verifying the suitability and accuracy of materials they provide for their intended educational use.
7. Privacy, Personal Information, and Security
EduCase processes personal information as described in its published Privacy Policy and applicable agreements.
Personal information may include registration details, institutional affiliations, user identifiers, account activity, educational submissions, contouring results, assessment scores, and technical access records.
Access to personal information is restricted according to operational responsibilities and authorized permissions.
Institutional clients and examination authorities may be given access to the information and results associated with their authorized programs.
EduCase maintains reasonable administrative, technical, and organizational safeguards appropriate to the Services and information processed.
No internet-based service can guarantee absolute security.
Where required, additional privacy, confidentiality, data processing, or security terms may be established through a written Service Agreement or data processing agreement.
8. Data Ownership, Retention, Export, and Deletion
Unless otherwise agreed in writing, institutional clients retain their applicable rights to submitted educational materials and program data.
User submissions, results, and educational records may remain available during the contracted access period, subject to permissions and system functionality.
Data export: An institutional client may request an available export of its authorized program records before its access period expires. Export formats, permitted content, fees for nonstandard requests, and delivery arrangements may be governed by the Service Agreement.
Retention: EduCase retains personal information and client data for the periods specified in its Privacy Policy, applicable Service Agreement, retention schedule, or legal requirements.
Deletion: Following expiration or termination, data eligible for deletion will be handled under the applicable retention and deletion procedures. Certain information may be retained where necessary for legal compliance, accounting, security, dispute resolution, or other lawful purposes.
Backups: Copies held in system backups may remain temporarily until they are removed through the established backup retention and expiration cycle, except where further preservation is legally required.
Any specific deletion deadline, backup expiration commitment, or certified deletion requirement must be documented in the applicable Privacy Policy, data processing agreement, or Service Agreement.
9. Institutional Workshops and Educational Programs
Institutional workshops, training events, residency programs, examinations, and related engagements are governed by the scope and terms of the applicable Service Agreement.
Depending on the engagement, these may specify:
- Number and type of clinical cases.
- Number of authorized participants.
- Educational or examination dates.
- Access periods.
- Homework and assessment requirements.
- Technical configuration and testing.
- Faculty and administrative responsibilities.
- Live-session technical attendance.
- Reports and deliverables.
- Pricing, invoicing, and payment schedules.
Services or deliverables not expressly included in the agreed scope are not automatically included.
Additional work, major configuration revisions, expanded participant capacity, new cases, extra live sessions, or extended access may require written approval and additional fees.
10. Fees and Payment
Fees for institutional Services are established in the applicable Service Agreement, quotation, invoice, or approved written order.
Payment methods may include bank transfer or other payment channels accepted by EduCase and identified in the payment instructions.
The applicable agreement or invoice determines currency, payment deadlines, and any approved payment arrangements.
Client-side bank fees, exchange charges, applicable taxes, and payment processing fees are allocated as stated in the applicable agreement or invoice, subject to applicable law.
EduCase may suspend future access, provisioning, or unperformed Services for materially overdue payments after appropriate written notice, except where a separate written agreement provides otherwise.
Individual digital products, subscriptions, and online purchases are subject to the prices and checkout terms displayed at the time of purchase.
11. Refunds, Cancellation, and Postponement
11.1 Individual digital purchases
Unless otherwise required by applicable law or stated in the relevant offer, purchases of digital educational materials or subscriptions are generally non-refundable once access has been provided.
Where purchased content or functionality materially differs from its published description, EduCase may investigate and provide an appropriate remedy, including correction, replacement, restored access, or a refund where warranted or legally required.
11.2 Institutional Services
Institutional cancellation, refund, and postponement provisions are governed first by the applicable Service Agreement.
Unless otherwise agreed in writing:
- Fees for completed work, configured services, and delivered digital access remain payable.
- Nonrecoverable third-party costs and approved expenses remain the responsibility of the contracting client.
- Requests to cancel or postpone must be submitted in writing.
- Any refund or credit for unperformed work will be evaluated based on the agreed scope, payments received, work performed, and applicable legal requirements.
- Rescheduled events are subject to platform and personnel availability.
If EduCase must cancel a contracted event for reasons within its reasonable control, the parties will seek an appropriate rescheduling arrangement or agreed remedy for undelivered Services.
This section does not override any mandatory statutory refund rights.
12. Access Periods and Renewal
Platform access is provided for the period identified in the applicable purchase, subscription, or Service Agreement.
Expiration of access does not create an automatic right to continued availability, additional services, or continued access to educational materials.
Institutional programs do not automatically renew unless the parties expressly agree to automatic renewal in writing.
Renewals, extensions, and reuse of previously configured cases may involve additional charges and are subject to a new agreement, renewal confirmation, or approved written order.
Consumer subscriptions that expressly include automatic renewal are governed by the renewal and cancellation information disclosed during purchase, including legally required notices and cancellation rights.
13. System Availability and Technical Support
EduCase makes commercially reasonable efforts to maintain reliable platform operations and provide technical support within its established service capabilities.
Temporary interruptions may arise from maintenance, software updates, hosting infrastructure issues, cybersecurity incidents, third-party failures, or circumstances outside EduCase's reasonable control.
EduCase is not responsible for failures in participant devices, institutional networks, local electricity supplies, internet service providers, institutional firewalls, or other systems outside EduCase's control.
Technical assistance may be provided to investigate connectivity or access issues, but such assistance does not constitute a guarantee of third-party network performance.
Specific availability commitments, incident response targets, recovery procedures, or dedicated examination support are binding only when expressly stated in an applicable signed Service Agreement or service-level agreement.
Planned maintenance will be communicated in advance when reasonably practicable.
14. Live Events and Technical Attendance
EduCase does not automatically provide staff attendance at live workshops, webinars, examinations, or other events unless such attendance is included in the agreed scope.
Live-session technical support, including evening, weekend, holiday, or other out-of-hours attendance, must be expressly scheduled or approved.
Additional attendance, extended event durations, unscheduled sessions, or specialized technical requirements may be subject to additional fees.
Faculty members and organizers remain responsible for educational instruction, event management, and their institutional participants unless otherwise agreed.
15. Acceptable Use and Prohibited Activities
Users must not:
- Attempt unauthorized access to accounts, clinical cases, or institutional records.
- Interfere with platform performance or security.
- Introduce malicious code, automated attacks, or other harmful software.
- Impersonate another person or misrepresent institutional authorization.
- Upload unlawful, unauthorized, or improperly disclosed personal or clinical information.
- Copy or redistribute restricted educational resources without permission.
- Circumvent assignment, examination, grading, or access controls.
- Use the platform for unlawful activities or unauthorized commercial exploitation.
- Attempt to manipulate examination results, assessments, or competency records.
EduCase may investigate suspected misuse and implement proportionate restrictions, including account suspension or termination.
16. Third-Party Services and External Dependencies
EduCase may rely on third-party infrastructure, hosting services, payment processors, external educational resources, and other technology providers.
Third-party systems may be subject to separate terms and policies.
EduCase is not responsible for the independent operation, content, or conduct of unrelated third-party services, except to the extent required by applicable law or expressly assumed in a written agreement.
17. Disclaimer of Warranties
Except as expressly provided in a signed Service Agreement or as required by law, EduCase Services are provided on an "as is" and "as available" basis.
To the fullest extent permitted by applicable law, EduCase disclaims implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
EduCase does not guarantee uninterrupted operation, error-free performance, continuous third-party connectivity, or any specific educational, clinical, certification, or examination outcome.
Nothing in this section limits an express service commitment contained in a signed agreement.
18. Limitation of Liability
To the maximum extent permitted by applicable law, RadOnc eLearning Center, LLC, its managers, officers, employees, contractors, and authorized representatives shall not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including lost profits, business interruption, or loss of opportunity, arising from or related to use of EduCase Services.
EduCase shall not be responsible for consequences arising from unauthorized clinical use, inaccurate third-party educational materials, participant misuse, or failures of client-controlled infrastructure, except to the extent liability cannot lawfully be excluded.
Any limitations or exclusions of direct damages or any monetary liability cap shall be governed by the applicable signed Service Agreement where one exists, and otherwise by applicable law.
Nothing in these Terms excludes liability that cannot legally be excluded, including liability arising from conduct for which exclusion is prohibited by applicable law.
19. Indemnification
To the extent permitted by applicable law, users and institutional clients agree to defend, indemnify, and hold harmless RadOnc eLearning Center, LLC and its representatives against third-party claims arising from their unlawful use of the Services, unauthorized submission or disclosure of data, infringement of third-party rights, or material violations of these Terms.
Institutional indemnification obligations may be further defined or limited by an applicable signed Service Agreement.
20. Suspension and Termination
EduCase may suspend or terminate access for material violation of these Terms, unauthorized use, security risks, legal requirements, or nonpayment as permitted by the applicable agreement.
Where reasonably practicable, EduCase will provide notice and an opportunity to correct the issue before terminating access.
Immediate suspension may occur where necessary to address serious security threats, unlawful conduct, or significant risks to other users.
Upon termination or expiration, the user's license to access the affected Services ends.
Data retention, export, and deletion shall be handled according to Section 8 and applicable written agreements.
Provisions concerning intellectual property, confidentiality, liability, indemnification, dispute resolution, and accrued payment obligations survive termination to the extent applicable.
21. Changes to Services and Terms
EduCase may update its platform, functionality, security procedures, and these Terms from time to time.
Material changes to the Terms will be identified through an updated effective date and reasonable notification when appropriate.
Changes will ordinarily apply prospectively.
An update to these published Terms does not unilaterally modify the commercial terms, pricing, duration, or expressly negotiated commitments of an existing signed Service Agreement.
Continued use after the effective date of validly notified updates constitutes acceptance where permitted by applicable law.
22. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles.
Unless a signed Service Agreement provides otherwise, disputes arising from these Terms shall be brought before the competent state or federal courts located in Wyoming, subject to applicable law and enforceable jurisdictional requirements.
The parties consent to such jurisdiction to the extent legally permitted.
Nothing in this section overrides mandatory protections or jurisdictional rights that cannot lawfully be waived.
23. Time Limit for Claims
To the extent permitted by applicable law, a claim arising from or relating to use of EduCase Services must be commenced within one (1) year after the claim accrues.
This contractual period does not apply where a longer period is mandated by applicable law or where contractual shortening of the limitation period is prohibited.
A signed Service Agreement may establish different enforceable limitations for the contracting parties.
24. Language
These Terms are maintained in English.
Translations may be provided for convenience or to support international clients.
Unless an applicable signed agreement expressly provides otherwise, the English-language version controls in the event of inconsistency between translations, subject to mandatory local law.
Where a bilingual Service Agreement specifies controlling language or equal authority of both versions, that agreement governs.
25. General Provisions
Entire Agreement: These Terms, the applicable Privacy Policy, and any signed Service Agreement or incorporated contractual documents constitute the governing terms for the relevant Services, subject to the order of precedence stated above.
Severability: If a provision is found unenforceable, the remaining provisions remain effective to the extent permitted by law.
No Waiver: Failure to enforce a provision does not constitute a waiver of future enforcement.
Assignment: Users may not transfer accounts or contractual rights without appropriate authorization. Assignment of institutional agreements is governed by their respective terms.
No Third-Party Beneficiaries: These Terms do not create enforceable rights for third parties except where expressly provided or required by law.
Force Majeure: Neither party shall be responsible for delays caused by extraordinary circumstances beyond its reasonable control, except for obligations that cannot lawfully be excused. The affected party shall use reasonable efforts to mitigate the impact and provide notification where practicable.
